This toolkit supplies the actual paper a household needs to obtain, keep, and defend federally assisted housing. It opens with a rent worksheet that turns income into an affordability ceiling before any apartment is visited, and a search log built to double as evidence. Eight model letters follow, covering the administrative plan request, the voucher extension, the interim recertification, the reasonable accommodation and modification request, the inspection demand, the informal hearing request paired with a file demand, the repayment negotiation, and the portability notice. A hearing packet supplies an exhibit index, a cross-examination script, and a closing statement skeleton. Separate modules address domestic violence protections, source-of-income refusals, and the landlord's side of the housing assistance payments contract. An authority card links every governing statute, regulation, and decision to its text. Everything is written to be filled in and sent by someone with no legal training.

Tool 1 — The rent worksheet
Do this before looking at a single listing. Authority: 42 U.S.C. § 1437a, 24 CFR Part 5.
| Line | Source | Amount |
|---|---|---|
| Wages, all members | Pay stubs × pay periods | |
| Self-employment net | Records | |
| Social Security / SSI | Award letter | |
| Pension / annuity / disability | Award letter | |
| Unemployment | Determination | |
| Child support / alimony received | Records | |
| Regular gifts from outside the household | Statement | |
| Other | ||
| A. ANNUAL INCOME | sum | |
| Dependent deduction × number of dependents | − | |
| Elderly or disabled family deduction | − | |
| Unreimbursed medical above threshold (elderly/disabled only) | Receipts | − |
| Disability assistance expenses | Receipts | − |
| Child care enabling work or school | Receipts | − |
| B. ADJUSTED INCOME | A minus deductions | |
| C. Monthly adjusted income | B ÷ 12 | |
| D. Monthly gross income | A ÷ 12 | |
| E. 30% of C | ||
| F. 10% of D | ||
| G. Minimum rent | Administrative plan | |
| H. TOTAL TENANT PAYMENT | highest of E, F, G | |
| I. AFFORDABILITY CEILING | 40% of C |
⭐ Line I is the number that matters. At initial lease-up the family share generally cannot exceed it. A unit whose rent puts the family above line I will not be approved, no matter what the landlord says.
Then get from the authority, in writing: the payment standard for your bedroom size · the utility allowance schedule.
Screen every listing: gross rent (rent + utility allowance) at or below the payment standard is comfortable. Above it, the family pays the difference — and line I decides whether that is even permitted.
Tool 2 — The search log
Every row is evidence: for an extension request, and for a source-of-income complaint.
| Date | Address | Rent | Bedrooms | Landlord / contact | Outcome | Notes |
|---|---|---|---|---|---|---|
Outcome codes: A applied · R-V refused because of the voucher · R-O refused for another stated reason · F-R failed rent reasonableness · F-I failed inspection · LEASED leased to someone else · NR no response
☐ ⭐ Every R-V row is a potential violation where a source-of-income law applies. Screenshot the text or listing immediately — listings are edited, texts are deleted.
Tool 3 — The administrative plan and payment standard request
[Date] · [Housing Authority] · Case/voucher number: [number]
Re: Request for public documents
I request copies of the following:
- The current administrative plan, including the sections on local preferences, voucher term and extensions, payment standards, reporting requirements, termination policy, and the informal hearing procedure.
- The payment standard schedule by bedroom size currently in effect.
- The utility allowance schedule.
- The statement of family obligations.
- The agency plan required by 24 CFR Part 903.
If any document is available online, please provide the link. If there is a copying charge, please tell me the amount before copying.
[Signature · printed name · address · telephone]
⭐ This letter answers more questions than any lawyer will in a first meeting. Send it the week the voucher is issued.
Tool 4 — The voucher extension request
[Date] · Voucher number: [number] · Voucher expires: [date]
Re: Request for extension of voucher term
My voucher expires on [date]. I request an extension of [60/90] days.
My search log is attached. I have contacted [number] landlords and applied to [number] units. The units I could not secure failed for the following reasons: [X] landlords declined to accept the voucher; [X] units exceeded the payment standard or failed rent reasonableness; [X] units failed inspection; [X] were leased before my application was processed.
[If applicable:] I am also requesting this extension as a reasonable accommodation. A member of my household has a disability that has limited my ability to search, specifically [barrier]. Verification is attached. I make this request under 29 U.S.C. § 794, 42 U.S.C. § 12132, and 24 CFR Part 8.
[If applicable:] I also request an exception payment standard, because units meeting my household's accessibility needs are not available within the current standard.
Please respond in writing before my voucher expires.
☐ ⚠ Send before the expiration date. An extension request after expiration is a different and much harder conversation.
Tool 5 — The interim recertification request
The most valuable letter in this toolkit measured in dollars.
[Date] · Case number: [number]
Re: Request for interim recertification — decrease in income
My household income decreased on [date]. Specifically: [I lost my job at ___ on ___ / my hours were reduced from ___ to ___ / my benefits ended / a household member who contributed income moved out].
Documentation is attached: [termination letter / final pay stub / benefit notice / statement].
I request an interim recertification and a corresponding reduction in my tenant portion, effective as soon as the rules permit.
Please confirm receipt of this request in writing and tell me the effective date of the new tenant portion.
☐ ⭐ The reduction runs from the request, not from the change. Every week of delay is money the household does not get back. Hand-deliver it and get a date stamp.
Tool 6 — The reasonable accommodation and modification request
[Date] · Case number: [number] · To: [housing authority / landlord / owner]
Re: Request for reasonable accommodation [and modification]
A member of my household has a disability.
The barrier. The following rule, policy, practice, or physical condition limits our equal opportunity to use and enjoy our housing: [describe the barrier — not the diagnosis].
The request. I request the following change: [be specific — an additional bedroom for a live-in aide · an extended voucher term · a home visit instead of an office appointment · assistance completing forms · rescheduling of the recertification appointment · waiver of the no-pets rule for an assistance animal, without a pet deposit · a transfer to a ground-floor or accessible unit · an exception payment standard · a third party designated to receive copies of all notices · reinstatement conditioned on a services agreement rather than termination].
[If a physical change:] I also request a reasonable modification: [grab bars · a ramp · a widened doorway · a roll-in shower · a visual doorbell or alarm · lever handles]. In federally assisted housing the cost of such modifications may be borne by the provider under 24 CFR Part 8.
Verification is attached from [physician / therapist / social worker / case manager] confirming the disability and the need for the requested change.
I make this request under 42 U.S.C. § 3604, 24 CFR Part 100, 29 U.S.C. § 794, and 42 U.S.C. § 12132.
Please respond in writing by [date]. If the request is denied, please state the reason in writing and identify what alternative you propose, so that we may discuss it.
☐ ⭐ The request does not require the word "accommodation" and does not require a diagnosis. A verification confirming a disability and the need for the change is enough.
☐ ⚠ Silence is not a lawful denial. The provider must engage. Follow up in writing and note the date of the first request.
Tool 7 — The hearing request and file demand
☐ ⚠ Send this the day the termination notice arrives. The deadline is commonly ten to fifteen days.
[Date] · [Housing Authority] · Case/voucher number: [number]
Re: Request for informal hearing — notice dated [date]
I request an informal hearing on the notice dated [date], which states that my assistance will be terminated effective [date].
I dispute the action. [State briefly — "The notice does not identify which family obligation I am alleged to have violated, on what date, or under what provision." · "I reported the change on [date]; a dated copy is enclosed." · "The person named in the record is not a member of my household." · "The individual involved no longer resides in the unit; documentation is enclosed." · "The authority has not considered my accommodation request of [date]."]
I request a copy of my entire file, including all notices, worker notes, income calculations, inspection reports, the documents the authority intends to rely on at the hearing, and any record of consideration of mitigating circumstances. I request these before the hearing so that I may prepare.
I request that the hearing be conducted by a person who did not make or approve this decision.
[If applicable:] I request [an interpreter in [language]] [the following accommodation to participate: ___].
[If applicable:] I request that my assistance continue pending the decision.
Please confirm receipt in writing and advise of the hearing date.
Send three ways: mail with proof of delivery, portal or fax, and hand delivery. Keep every receipt.
Tool 8 — The inspection request
[Date] · Case number: [number] · Unit address: [address]
Re: Request for housing quality standards inspection
The following conditions exist in my unit and have not been repaired: [list each — no heat since [date] · no hot water · leaking roof · inoperable plumbing · broken window · no working smoke detector · pest infestation · exposed wiring · deteriorated paint].
I notified the owner in writing on [date]. A copy is attached. The conditions have not been corrected.
I request an inspection of my unit.
I understand that if the unit fails and the owner does not correct the conditions, the housing assistance payment may be abated. I will continue to pay my own portion of the rent in full during any abatement.
☐ ⛔ Keep paying the tenant portion. Withholding it converts a strong habitability position into an ordinary non-payment eviction the household will lose.

Tool 9 — The repayment negotiation letter
[Date] · Case number: [number] · Claim number: [number]
Re: Response to claim of overpaid housing assistance
1. I request the month-by-month calculation: for each month claimed, the income and household composition used, the tenant portion charged, the tenant portion the authority now says was correct, and the difference.
2. I request the reporting rule in effect during the period claimed, from the administrative plan, and identification of the specific requirement I am alleged to have violated.
3. I reported the change on [date] by [method] to [name]. [A dated copy is enclosed. / Please produce the worker notes for that date.]
4. To the extent the amount results from a calculation error by the authority using information I correctly supplied, this is agency error and not a violation of my family obligations.
5. I dispute any portion of the claim reaching months barred by the applicable time limit.
6. In the alternative, I request an affordable repayment amount. My monthly budget is attached. I can pay $[amount] per month.
7. I do not admit fraud and I will not sign any agreement containing such an admission.
8. I request an informal hearing on this claim.
Tool 10 — The portability and move notices
Portability
[Date] · Voucher number: [number]
Re: Request to port to [receiving jurisdiction]
I request to use my voucher in [city/county/state], where I intend to move because [employment · family · safety · accessibility · education]. Please advise of the steps required, the receiving housing authority's contact, the timing, and the receiving authority's payment standard for my bedroom size, so that I can plan.
My current lease [ends on [date] / permits termination on [notice]].
Notice of intent to vacate
I am giving notice that I intend to vacate [address] effective [date]. I am providing this notice to the housing authority and to the owner as my family obligations require.
☐ The receiving authority's payment standard applies — it can change the family share substantially in either direction.
Tool 11 — Domestic violence protections
[Date] · Case number: [number]
Re: Assertion of housing protections for a survivor
I am a survivor of [domestic violence / dating violence / sexual assault / stalking]. I am invoking the protections available to survivors in covered housing programs, implemented through 24 CFR Part 5.
[As applicable:] The conduct cited in your notice dated [date] was directly related to the abuse committed against me and was engaged in by [the abuser], not by me. It cannot be the basis for terminating my assistance.
[As applicable:] I request lease bifurcation to remove [name] from the lease while my household retains the unit and the assistance.
[As applicable:] I request an emergency transfer. I reasonably believe there is a threat of imminent harm if I remain in this unit.
I am providing self-certification, which is sufficient documentation. I request that all information provided be kept confidential.
☐ ⚠ These protections must be invoked. Nobody screens for them.
Tool 12 — The source-of-income refusal complaint
Use where the jurisdiction prohibits refusing a tenant because of a housing subsidy.
Complaint of unlawful refusal based on source of income
Property: [address] · Owner/agent: [name] · Date of refusal: [date]
What was said, verbatim: "[quote exactly]"
How it was communicated: [text message · email · listing language · telephone call · in person, witnessed by ___]
Evidence attached: [screenshot · printout of listing · call log · witness statement]
I am otherwise qualified: I met the stated rent-to-income, credit, and rental history criteria as follows: [state].
Requested relief: investigation, correction of the policy, and the remedies available under the applicable ordinance and, where applicable, 42 U.S.C. § 3604 and 42 U.S.C. § 3617.
☐ ⭐ Screenshot before you complain. Listings get edited within hours.
☐ See also Documenting and Pursuing a Fair Housing Complaint: A Practical Checklist and The Fair Housing Complaint Toolkit.
Tool 13 — The hearing packet
13A — Exhibit index
| # | Document | Date | Purpose |
|---|---|---|---|
| 1 | The termination notice | The action appealed | |
| 2 | The envelope | Receipt date | |
| 3 | The hearing request | Timeliness | |
| 4 | The file request and any response | What the authority did and did not produce | |
| 5 | Dated copies of change reports | Defeats "failure to report" | |
| 6 | Pay stubs / benefit letters | Actual income | |
| 7 | Recertification packet and proof of submission | Defeats "failure to recertify" | |
| 8 | The accommodation request | Independent defense | |
| 9 | Written bar of the offending member | Mitigation | |
| 10 | Treatment / employment / program records | Mitigation | |
| 11 | Letters of support | Mitigation | |
| 12 | Inspection reports and repair requests | Condition history | |
| 13 | Call log | Rebuts "no record of that" |
13B — The cross-examination script
- "What is the specific family obligation the authority says was violated? Please read the provision."
- "What evidence, other than the allegation, shows the conduct occurred?"
- "Is that an arrest record or a record of conviction?"
- "Where in the file is the household's report of [date] recorded?"
- "Was this document produced to me before today?"
- "What mitigating circumstances did the authority consider? Where is that recorded in the file?"
- "Did the authority consider the accommodation request dated [date]? What was the response?"
- "Does the administrative plan give the authority discretion here? Please read that provision."
13C — Closing statement skeleton
"The authority has not met its burden. The notice failed to identify [the obligation / the date / the provision], which prevented me from preparing a defense. On the merits, [one sentence of fact]. Even if the ground were proven, the administrative plan gives the authority discretion, and the file shows no consideration of [tenancy length / effect on my children / removal of the individual / my accommodation request]. I ask that the termination be withdrawn."
⭐ Ask for the decision in writing with findings, and request the recording or transcript the same day.
Tool 14 — The landlord's contract checklist
☐ Read the housing assistance payments contract, not only the lease. They are two documents with two sets of obligations.
☐ Confirm the approved rent to owner and the utility allocation in writing.
☐ ⛔ No side payments, premiums, or separate charges for items included in the rent. Discovered at recertification; consequences include repayment and removal from the program.
☐ Maintain the unit to housing quality standards throughout. ⭐ Abatement is faster and costlier than any code citation.
☐ Notify the authority of any termination of tenancy in the required form and time.
☐ Screen for tenancy — rental history, prior evictions, ability to pay the tenant share. Program eligibility is not tenancy suitability.
☐ Grant reasonable accommodations and permit modifications — 42 U.S.C. § 3604, 24 CFR Part 100.
☐ Do not say "we don't take Section 8" in writing where a source-of-income ordinance applies.
☐ Project-based owners: check every notice against 24 CFR Part 247 — good cause, specific grounds, opportunity to respond. The owner is generally limited at trial to the grounds stated.
