Subsidized Housing: A Comprehensive Guide to Vouchers, Public Housing, Terminations, and Grievances

42 U.S.C. § 1437

This guide is a working reference for federally assisted housing: what the programs are, how eligibility and rent are determined, what obligations a household carries, and what happens procedurally when assistance is denied, reduced, or terminated. It covers tenant-based vouchers, public housing, and project-based assistance separately, because the hearing rights differ in ways that decide cases. Detailed sections address income and deduction calculations with worked figures, the payment standard and affordability cap, housing quality standards and abatement, portability, interim and annual recertification, repayment agreements, and the criminal-activity provisions. Procedural chapters set out the informal hearing for voucher holders, the grievance procedure for public housing residents, and the federal notice requirements layered on state eviction law in project-based properties. Reasonable accommodation and modification are treated at length because they are the most consequential and least used tools available. A chapter for landlords explains the housing assistance payments contract and the five errors that cost owners money. Primary statutes, regulations, and decisions are linked throughout to their text on uplaw.us.

How to use this guide. Chapters 1–3 identify which program a household is in, because nothing else can be answered until that is settled. Chapters 4–7 cover money — eligibility, income, rent, and the payment standard. Chapters 8–11 cover the tenancy — the search, the inspection, the recertification, and the obligations. Chapters 12–15 cover losing assistance and fighting back. Chapter 16 is written for landlords. Chapter 17 is a reference table of authorities.
