This toolkit collects the working documents a servicemember, an employer, or a creditor actually needs. It includes the deployment binder index, the six-percent interest letter, the lease and vehicle lease terminations, the stay application with both required letters, the default judgment reopening motion outline, the reemployment application, the escalator worksheet, the demand letter to a noncompliant employer, the Department of Labor complaint outline, and the discrimination narrative that organizes the evidence. It adds a compliant military leave policy for employers and a compliance checklist for creditors and landlords. It closes with an authority reference table and a routing table to the rest of the corpus.

Tool 2 — The six percent interest letter
[Date] To: [Creditor] — Attn: Military Benefits / SCRA Compliance Re: Account [] · [Name] · Last four SSN []
I am a member of the [branch] and entered active duty on [date]. A copy of my orders is enclosed.
The above obligation was incurred before my entry on active duty. Under the Servicemembers Civil Relief Act, interest on a pre-service obligation is limited to 6% per year during the period of military service. The amount above 6% is forgiven, not deferred, and the periodic payment must be reduced by the amount of interest forgiven.
I request that you:
- Apply the 6% rate retroactive to [date];
- Recalculate the account and refund any amount collected in excess;
- Reduce my periodic payment by the amount of interest forgiven;
- Confirm items 1 through 3 in writing within 30 days; and
- Ensure the account is reported accurately to consumer reporting agencies.
If you contend that my ability to pay is not materially affected by military service, please so advise — ⚠ that determination requires a court order.
[Name · Rank · Mailing address · Email]
☐ Send one per obligation. ☐ Attach orders. ☐ Keep proof of mailing. ☐ Calendar 30 days.
Tool 3 — Lease and vehicle lease termination
Residential:
Re: Lease dated [____] for [address]
Enclosed is a copy of my [entry on active duty / permanent change of station / deployment] orders dated [____]. Pursuant to the Servicemembers Civil Relief Act, I am terminating this lease. Termination is effective [date computed under the statute].
Please provide a final accounting and refund all unearned prepaid rent and the security deposit to [address] within the time required by [state] law. ⚠ No early termination fee, penalty, or liquidated damages charge is permitted. Please confirm in writing.
Motor vehicle lease:
Re: Motor vehicle lease [] — [year/make/model], VIN []
Enclosed are my orders dated [____]. I am terminating this lease under the Servicemembers Civil Relief Act, effective on delivery of the vehicle. Please advise where and when to return it. No early termination charge is permitted, and unearned prepaid lease amounts must be refunded within the statutory period.
Telecommunications:
Re: Account [____]
Enclosed are my orders dated [____] requiring relocation to [location]. I am terminating this contract under the Servicemembers Civil Relief Act. Please waive all early termination fees and confirm the final balance in writing.
Tool 4 — Stay application package
Motion caption and body:
Motion for Stay of Proceedings Under the Servicemembers Civil Relief Act
[Name] moves for a stay of at least 90 days. In support: (1) movant is a member of the [branch] on active duty at [location] under orders dated [____], attached as Exhibit A; (2) movant's current military duty materially affects the ability to appear, as set out in the letter attached as Exhibit B; (3) the letter of movant's commanding officer, attached as Exhibit C, states that current military duty prevents appearance and that military leave is not authorized; and (4) movant requests a stay through [date].
Movant further requests that, if any additional stay is refused, the Court appoint counsel to represent movant.
Exhibit B — the servicemember's letter:
I am serving on active duty at [location] under orders dated [____]. My current duty materially affects my ability to appear in this matter because [deployment location and travel restrictions / mission schedule and duty hours / limited or intermittent communications / no authorized leave]. I anticipate being available on or after [date]. I request a stay of at least 90 days.
Exhibit C — the commanding officer's letter:
[Rank/Name] is assigned to this command and is currently performing military duty at [location]. [Rank/Name]'s current military duty prevents appearance in the above-referenced proceeding. Military leave is not authorized for [Rank/Name] at this time. [Optional: [Rank/Name] is expected to become available on or about [date].]
⚠ Both letters, with specific facts. Boone v. Lightner, 319 U.S. 561, leaves this to the trial court's discretion — ⭐ facts win it; formulas do not. And read the Act liberally where the facts are close: Le Maistre v. Leffers, 333 U.S. 1.
Tool 5 — Reopening a default judgment
Motion outline:
☐ Identify the judgment: court, case number, date entered, amount, and current enforcement (garnishment, levy, lien). ☐ Establish military service on the date of entry, with orders attached. ☐ Attach the plaintiff's military service affidavit — or establish that none was filed. ☐ ⚠ If the affidavit was false, say so plainly; penalties attach to a knowingly false affidavit. ☐ Show that military service materially affected the ability to make a defense — where stationed, communications, leave, notice actually received. ☐ State the meritorious or legal defense, with specifics: the amount is wrong; the claim is time-barred; the plaintiff cannot prove assignment; the goods were never delivered. ☐ Establish timeliness — application made during service or within the trailing period. ☐ Plead the independent voidness theory where service was defective. ⭐ These are separate arguments with separate elements; plead both. ☐ Request: vacatur, dissolution of garnishment, return of funds collected, and leave to answer. ☐ Note tolling of any affirmative claims — Conroy v. Aniskoff, 507 U.S. 511.
Tool 6 — Reemployment application
[Date] · To: [Employer] — Attn: Human Resources Re: Application for reemployment — [Name], [former position]
I served in the uniformed services from [date] to [date]. My separation was under honorable conditions; documentation is enclosed. I gave notice of my service on [date].
I hereby apply for reemployment under 38 U.S.C. § 4312, and request placement under 38 U.S.C. § 4313 in the position I would have attained with reasonable certainty had my employment not been interrupted.
Please confirm in writing, before my start date:
- The position, title, and rate of pay to which I am being returned, and the analysis by which it was determined;
- My seniority date, computed as though employment had been continuous;
- Reinstatement of health coverage effective immediately, with no waiting period and no exclusion, under 38 U.S.C. § 4317;
- Pension service credit for the period of service, and the schedule for any make-up contributions, under 38 U.S.C. § 4318;
- Restoration of accrued benefits on the terms applicable to comparable leaves, under 38 U.S.C. § 4316.
I am available to begin on [date].
⚠ I note that under 38 U.S.C. § 4302, reemployment rights may not be reduced or limited by contract, agreement, policy, plan, or practice, and no additional prerequisite may be imposed. I am therefore not able to sign a release or similar agreement as a condition of reemployment.
⭐ Question 1 is the entire case. Ask it before you accept anything.
Tool 7 — The escalator worksheet
| At departure | Peers now | Offered to me | Gap | |
|---|---|---|---|---|
| Title | ||||
| Level / grade | ||||
| Base pay | ||||
| Shift | ||||
| Reports to | ||||

Advancement classification:
| Advancement peers received | Date | Tenure-based | Competitive | Mine? |
|---|---|---|---|---|
| ☐ | ☐ | ☐ | ||
| ☐ | ☐ | ☐ | ||
| ☐ | ☐ | ☐ |
☐ Tenure-based is yours with reasonable certainty — Tilton v. Missouri Pacific Railroad Co., 376 U.S. 169. ☐ ⚠ Competitive is not automatic — McKinney v. Missouri-Kansas-Texas Railroad Co., 357 U.S. 265. ☐ Seniority is computed as though continuous — Fishgold v. Sullivan Drydock & Repair Corp., 328 U.S. 275. ☐ Seniority-based compensation cannot exclude the service period — Accardi v. Pennsylvania Railroad Co., 383 U.S. 225. ☐ Pension is a perquisite of seniority — Alabama Power Co. v. Davis, 431 U.S. 581; and see Coffy v. Republic Steel Corp., 447 U.S. 191. ☐ ⚠ Equal treatment, not preferential — Monroe v. Standard Oil Co., 452 U.S. 549. ☐ Length of service does not extinguish rights — King v. St. Vincent's Hospital, 502 U.S. 215.
Tool 8 — Demand letter to a noncompliant employer
[Date] · To: [Employer] — Attn: [General Counsel / HR Director] Re: Reemployment of [Name] — 38 U.S.C. § 4301 and following
[Name] served in the uniformed services from [date] to [date], gave notice on [date], and applied for reemployment on [date]. The company has [offered a position at a lower level and rate of pay / declined to reemploy / reemployed and then terminated within the protected period / denied a benefit of employment].
The escalator position. 38 U.S.C. § 4313 requires reemployment in the position that would have been attained with reasonable certainty had employment not been interrupted. During the service period, each of [Name]'s comparators at the same level advanced to [level] at [rate] on the company's standard tenure schedule. The position offered is [level] at [rate].
Seniority. Seniority must be computed as though employment had been continuous — Fishgold v. Sullivan Drydock & Repair Corp., 328 U.S. 275.
Benefits. 38 U.S.C. § 4317 requires immediate reinstatement of health coverage without waiting period or exclusion. 38 U.S.C. § 4318 requires pension service credit for the period of service.
Discharge protection. 38 U.S.C. § 4316 prohibits discharge except for cause for [one year / 180 days] following reemployment.
Non-diminishment. 38 U.S.C. § 4302 makes these rights non-waivable and prohibits additional prerequisites, including any release or agreement offered as a condition of reemployment.
Requested relief, within 14 days: placement in the escalator position at the corresponding rate; correction of the seniority date; retroactive pay and benefits; correction of pension credit; and written confirmation.
⚠ Absent resolution, [Name] will proceed under 38 U.S.C. § 4322 and 38 U.S.C. § 4323, which provide for lost wages and benefits, liquidated damages for willful violations, equitable relief, and attorney's fees. There is no exhaustion requirement and no general limitations period — 38 U.S.C. § 4327.
Tool 9 — Department of Labor complaint outline
☐ Claimant — name, contact, branch, component, unit ☐ Employer — legal name, address, size, type (private / state / local / federal) ☐ Employment — position, dates, supervisor, pay ☐ Service — dates, type, authority, character of separation, documentation attached ☐ Notice — when and how given, to whom ☐ Application for reemployment — date, method, attached ☐ What the employer did — with dates ☐ The escalator analysis — peers, advancement, pay ☐ The provisions at issue — 38 U.S.C. § 4311, 38 U.S.C. § 4312, 38 U.S.C. § 4313, 38 U.S.C. § 4316, 38 U.S.C. § 4317, 38 U.S.C. § 4318 ☐ Relief sought — reinstatement, back pay, benefits, seniority correction, pension credit, liquidated damages ☐ Documents attached — orders, notice, application, employer correspondence, org charts, pay records ☐ ⚠ Federal executive agency employees use 38 U.S.C. § 4324 instead; see also 38 U.S.C. § 4325 and, for hiring preference, 5 U.S.C. § 3330. Contractor obligations arise under 38 U.S.C. § 4212. Investigatory authority is at 38 U.S.C. § 4326.
Tool 10 — The discrimination narrative
⭐ Organize the evidence chronologically before writing anything. Adverse actions look random until they are on a timeline next to service events.
| Date | Service event | Workplace event | Who | Document |
|---|---|---|---|---|
| Drill weekend | ||||
| Notice of annual training given | ||||
| Denied training course | ||||
| Review notes "availability issues" | Review | |||
| Mobilization orders | ||||
| Position posted | Job posting | |||
| Return | ||||
| Offered lower-level role | Offer letter |
The elements:
☐ Adverse action — denial of employment, reemployment, retention, promotion, or any benefit of employment ☐ Protected basis — membership, application, performance, or obligation of service; or protected activity ☐ ⭐ Motivating factor — then the burden shifts to the employer to prove it would have acted the same way regardless ☐ The cat's paw pattern — a supervisor's animus, expressed in the record, proximately causing an action taken by a decisionmaker without animus — Staub v. Proctor Hospital, 562 U.S. 411 ☐ ⚠ Retaliation protection extends to non-servicemembers who assist, testify, or exercise rights — 38 U.S.C. § 4311
Tool 11 — Military leave policy for employers
Military Leave Policy
1. Coverage. This policy applies to all employees — full-time, part-time, temporary, and probationary — who perform service in the uniformed services, voluntary or involuntary, including active duty, active and inactive duty for training, full-time National Guard duty, funeral honors duty, and examinations for fitness. There is no minimum length of employment or service.
2. Notice. Employees should provide advance notice, written or verbal, as far in advance as practicable. Notice is excused where precluded by military necessity or otherwise impossible or unreasonable.
3. Status during service. Employees on military leave are treated as on furlough or leave of absence and receive the non-seniority benefits provided to employees on comparable leaves. ⭐ Employees may elect, but are not required, to use accrued vacation.
4. Health coverage. Continuation is offered for the period the law requires, at the premium share the law permits. On return, coverage is reinstated immediately, with no waiting period and no exclusion except for conditions determined to be service-connected.
5. Pension. The period of service is credited for vesting and accrual. The Company funds its obligation. Employees may make up contributions over the period the law allows.
6. Return. Employees report or apply within the statutory deadlines. The Company will determine the position to which the employee is entitled in writing, applying the escalator principle, and will make reasonable efforts at Company expense to qualify the employee for it.
7. Protection from discharge. Employees reemployed after more than 180 days of service will not be discharged except for cause for one year; after 31 to 180 days, for 180 days.
8. Nondiscrimination and non-retaliation. The Company does not discriminate on the basis of service, and does not retaliate against anyone who asserts, assists with, or testifies about a right under this policy.
9. No conditions. ⚠ Reemployment is never conditioned on a release, waiver, or agreement of any kind.
10. Notice posting. The required notice is posted at [location].
Tool 12 — Creditor and landlord compliance checklist
☐ Military status verified before every default affidavit. ⚠ A knowingly false affidavit carries penalties. ☐ 6% cap applied on receipt of written notice and orders, retroactive to the first day of service, with the payment reduced. ☐ ⚠ Excess interest forgiven — not deferred, not capitalized, not collected later. ☐ Any material-effect dispute taken to court, not decided at the call center. ☐ No foreclosure or sale on a pre-service mortgage without a court order or valid waiver. ☐ No repossession under a pre-service installment contract without a court order. ☐ No eviction below the rent threshold without a court order. ☐ Valid SCRA terminations honored, deposits and prepaid rent refunded, no early termination fee. ☐ Waivers checked for form: writing, separate instrument, 12-point type, executed during or after service. ☐ Tax protections respected for members and spouses — Dameron v. Brodhead, 345 U.S. 322. ☐ Veterans benefits treated as exempt — 38 U.S.C. § 5301. ☐ Limitations periods computed with tolling — Conroy v. Aniskoff, 507 U.S. 511. ☐ ⚠ Remember pattern-or-practice exposure to the Attorney General.
Tool 13 — Family and credit protections
Active duty alert request:

Please place an active duty alert on my file under 15 U.S.C. § 1681c-1, and exclude me from prescreened offers of credit and insurance for the period the statute permits. My contact information during this period is [], and my designated point of contact is [].
Military family leave request:
I request leave under 29 U.S.C. § 2612 for [a qualifying exigency arising from my [relation]'s covered active duty / to care for a covered servicemember with a serious injury or illness]. ⭐ For military caregiver leave, the entitlement is up to 26 workweeks in a single 12-month period. Certification is enclosed.
Disability accommodation, where a service-connected condition is in play:
