The questions arrive in a rush and in the wrong order. Is this even patentable? Should I bother? What does it cost? Did I already ruin it by posting the demo? This guide answers those questions in roughly the order they occur to a working founder or independent inventor, and it does so as a research resource rather than a sales pitch—the goal is to leave you able to ask sharper questions of a patent attorney, not to talk you into or out of anything. Two orientation points before the questions begin. First, this FAQ is about decisions, not filing mechanics. Second, nothing here is legal advice; patent deadlines are unforgiving and fact-specific, and the difference between a valuable right and an expensive souvenir often turns on details this article cannot see. The Bargain: What a Patent Actually Is Give me the one-sentence version. A patent is a trade you make with the public, brokered by the government. You teach the world how to make and use your invention—completely, in writing, on the public record—and in return you receive, for a limited number of years, the legal right to stop everyone else from making, using, selling, offering to sell, or importing that invention without your say-so. The authority runs all the way back to the founding charter: Congress may "promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries." U.S. Const. art. I, § 8, cl. 8. Congress exercised that power in Title 35 of the U.S. Code, and the operative grant sits at 35 U.S.C. § 154(a)(1): the right "to exclude others from making, using, offering for sale, or selling the invention throughout the United States or importing the invention into the United States." The Supreme Court likes to call this a "carefully crafted bargain": a finite period of exclusivity in exchange for a complete, working teaching that the public may freely use once the patent expires. Pfaff v. Wells Elecs., Inc., 525 U.S. 55, 63 (1998). The exclusivity is what you are buying. The teaching is the price. If you are unwilling to publish your secret to the world, the patent counter may be the wrong line to stand in—a point that returns below, under trade secrets. Which three words in that grant cost people money? Read § 154(a)(1) again and mark three words, because each has emptied a bank account belonging to someone who skimmed past it. Exclude. A patent is a right to keep others out, not a right to go in. It does not guarantee that you may lawfully make or sell your own invention. That sounds backwards until you meet a blocking patent (more on that later), but internalize it now: a patent is a sword, never a shield. Limited. A patent expires. A utility patent generally runs twenty years from the date of your earliest non-provisional U.S. filing (a provisional's date does not start that twenty-year clock), subject to maintenance fees along the way. A design patent runs fifteen years from grant. When the term ends, your teaching belongs to everyone. United States. The grant is stamped for one country. It stops infringement here and nowhere else. There is no such thing as a "world patent," and a U.S. patent does nothing to a factory in another country except at the U.S. border. The grant itself issues from the United States Patent and Trademark Office (USPTO), a federal agency in Alexandria, Virginia, that examines applications and decides who gets a patent and who does not. Patents are creatures of federal law from birth to death; there is no state patent, and patent disputes belong in federal court. What are the three kinds of patents? People blur them constantly, so keep the mnemonic function, form, flora: A utility patent protects the way something works or is used—a machine, a process, an article of manufacture, or a composition of matter, plus improvements on any of them. 35 U.S.C. § 101. A design patent protects the way something looks—the ornamental appearance of an article, not its function. 35 U.S.C. § 171. The silhouette of a speaker, the tread pattern of a boot, the arrangement of icons on a screen. Design patents last fifteen years from grant for applications filed on or after May 13, 2015 (35 U.S.C. § 173) and carry no maintenance fees. Do not dismiss them: they have produced enormous verdicts, and their obviousness law was just rewritten—see After LKQ v. A plant patent protects a new, distinct plant variety that has been asexually reproduced—a novel rose cultivar propagated by cutting, say. 35 U.S.C. § 161. It is the rarest of the three, and most readers will never need one. These categories are not mutually exclusive. Sort your product by what you are actually trying to defend: A patent protects an invention—how something works (utility) or how it looks (design). A copyright protects original expression—text, music, images, and software code as written text. It reaches the expression, not the underlying function or idea. A trade secret protects valuable secrecy—information that derives its value from not being known and that you take reasonable steps to keep hidden. A worked example (hypothetical). Suppose a startup called Latchkey launches a smart bike lock. The locking mechanism that resists bolt cutters is potential utility-patent territory. The lock's distinctive sculpted housing might support a design patent. The name "Latchkey" and its logo are trademarks. The firmware and the mobile app's source code are protected by copyright the moment they are fixed. And the server-side anti-theft heuristic that flags a stolen lock—never shipped, never disclosed—is a trade secret. One product, five different regimes, five different rulebooks and offices. Before spending a dollar, answer the sorting question: am I protecting how it works, what it's called, or the creative content? The answer points you to the right door, and plenty of products walk through more than one. Should You Patent at All? How do I decide whether a patent is worth the money? A patent is a commercial instrument, not a trophy. Its value depends less on the cleverness of the invention than on the business around it. Four honest questions: Is there a market someone would bother to copy? A patent has value only if a competitor would want to make your thing and you would want to stop them. A patent on a product nobody will buy is a costly paperweight. How easily can a rival design around it? If a competitor can reach the same result by a slightly different route, a narrow patent is a speed bump, not a wall. The breadth of your claims—the numbered sentences that legally define what you own—decides how hard you are to evade. This is why claim drafting is the whole ballgame, a theme repeated below. Would secrecy protect you better? Patents demand disclosure. If your edge can be genuinely hidden and is hard to reverse-engineer—a fabrication process, a formulation, an algorithm that never leaves your servers—a trade secret may protect it better and, in principle, forever. The classic illustration is a soft-drink formula that was never patented and therefore never entered the public domain; a patent would have expired more than a century ago. Trade secrecy lasts as long as the secret holds, but it offers nothing against a competitor who independently invents the same thing or lawfully reverse-engineers your product. The choice is often irreversible, because you cannot patent something you have already kept secret and commercialized past the deadline (see the on-sale bar, below). Could you afford to enforce it? A patent you cannot afford to litigate is mostly a deterrent and a balance-sheet asset. That is not nothing—a patent can scare off a copycat, anchor a licensing talk, clear an investor's diligence checklist, and add a real number in an acquisition—but be clear-eyed about the gap between owning a right and enforcing one. The candid answer for many independent inventors is "maybe." A good patent attorney earns part of the fee by talking some clients out of filing. What the Law Will—and Won't—Let You Patent What is patentable subject matter? By statute, a utility patent may cover any new and useful "process, machine, manufacture, or composition of matter, or any new and useful improvement thereof." 35 U.S.C. § 101. The Supreme Court once captured the intended sweep in a phrase Congress endorsed: patentable subject matter includes "anything under the sun that is made by man." Diamond v. Chakrabarty, 447 U.S. 303, 309 (1980). But courts have long fenced off three categories no amount of clever drafting can capture: Laws of nature. You cannot patent E = mc², or the relationship between a drug dose and a metabolite level as it exists in the body. Natural phenomena. You cannot patent a wild plant, a mineral, or a human gene exactly as it occurs in nature. Ass'n for Molecular Pathology v. Myriad Genetics, Inc., 569 U.S. 576 (2013), held that isolated naturally occurring DNA is a product of nature and unpatentable, while synthetic cDNA—which does not occur in nature—can be eligible. Abstract ideas. You cannot patent a pure mathematical formula or a basic method of organizing human activity, like hedging a risk. The reason is a policy judgment, not a technicality. These three are the "basic tools of scientific and technological work," and letting anyone monopolize them "might tend to impede innovation more than it would tend to promote it." Mayo Collaborative Servs. v. Prometheus Labs., Inc., 566 U.S. 66, 71 (2012). The system rewards applications of nature's principles, not the principles themselves. There are also specific exclusions worth knowing. A bare idea or wish—"a car that runs on water"—is not a patentable invention until it is worked out. A perpetual-motion machine fails the "useful" requirement because it does not work, and the USPTO has been known to demand a working model in those cases. Under the America Invents Act (Leahy-Smith America Invents Act, Pub. L. No. 112-29, 125 Stat. 284 (2011)), you cannot obtain a claim directed to or encompassing a human organism, and a strategy for reducing, avoiding, or deferring tax liability is deemed part of the prior art—so a tax strategy as such cannot furnish patentable novelty. Literary, musical, and artistic works belong to copyright, not patent law. What are the actual legal requirements—the gates an application has to clear? Five plain-English questions decide whether the USPTO grants a utility patent. They are the spine of the entire system: Eligible subject matter? Does the claim fall within § 101 and steer clear of the law-of-nature/abstract-idea exceptions? Useful? Does it do something specific, substantial, and credible? A low bar for almost everything, a real bar only for perpetual-motion devices and inventions with no identified real-world use. New (novel)? Was the exact invention already disclosed in the "prior art"? 35 U.S.C. § 102. If someone—including you—already put it out there, you may be too late. Non-obvious? Even if no single reference shows the whole invention, would the combination have been obvious to a person of ordinary skill in the field? 35 U.S.C. § 103. Most applications live or die here. The framework comes from Graham v. John Deere Co., 383 U.S. 1 (1966), and was made easier for examiners to invoke by KSR Int'l Co. v. Teleflex Inc., 550 U.S. 398 (2007), which junked rigid formulas in favor of common-sense reasoning. Described well enough? The application must enable a skilled person to make and use the invention and must contain a written description showing you actually possessed it. 35 U.S.C. § 112. These are two distinct requirements: enablement asks whether you taught how, written description asks whether you had it, per Ariad Pharms., Inc. v. Eli Lilly & Co., 598 F.3d 1336 (Fed. Cir. 2010) (en banc). The Supreme Court recently put teeth back into enablement in Amgen Inc. v. Sanofi, 598 U.S. 594 (2023): the more you claim, the more you must enable, and you cannot claim an entire genus while teaching only a handful of species. If you can answer "yes" to all five without flinching, you may have a patentable invention. Every place you flinch is a place you need help. Prior Art and the Search Question What exactly is "prior art"? Prior art is everything the public already knew before your filing date—the body of evidence an examiner, a competitor, or a court can hold up and say, "This already existed, so your invention is not new, or it is obvious." It is far broader than people expect. It is not just earlier patents. It includes earlier published patent applications, journal and trade articles, products already on sale, public demonstrations, conference talks, product manuals, a video posted online, a blog entry, and a thesis sitting on a single library shelf in another country in another language. If it was publicly available before you filed, it can count. The United States runs on first-inventor-to-file (the relevant AIA provisions took effect March 16, 2013), so the filing date—not the date you sketched the idea—is the date that matters most. Two consequences follow. First, your own public disclosures can become prior art against you. There is a limited one-year U.S. grace period for an inventor's own disclosures under 35 U.S.C. § 102(b)(1), but most other countries grant no grace period at all, which means a public reveal can instantly extinguish your foreign rights while starting a tight clock at home. Second, "I searched and found nothing" proves nothing except that you did not find it. Do I have to run a patent search before filing? You are not legally required to, and the USPTO will run its own search during examination either way. But a pre-filing search is usually money well spent, because finding a killer reference before you invest is far cheaper than finding it after. A good search does two jobs: it tells you whether the invention is plausibly new and non-obvious, and it maps the surrounding art so counsel can draft claims that thread between what already exists. A close-but-not-identical reference is often a gift, not a death sentence—it tells your attorney precisely which features to foreground in the claims. Once you or your attorney become aware of prior art material to patentability, you owe the USPTO an affirmative duty of candor and good faith—you must disclose it, typically through an Information Disclosure Statement. 37 C.F.R. § 1.56. Concealing a reference you knew was material is not a shortcut; it is the seed of an inequitable conduct defense that can render the entire patent unenforceable—what the Federal Circuit famously called the "atomic bomb" of patent law in Therasense, Inc. v. Becton, Dickinson & Co., 649 F.3d 1276 (Fed. Cir. 2011) (en banc). The counterintuitive lesson: you are safer finding and disclosing bad news than pretending you never saw it. You can, and doing so will teach you your field—but do it humbly. Professional searching is a learned craft. The classification systems are arcane (the Cooperative Patent Classification scheme runs to hundreds of thousands of subdivisions), and the most dangerous prior art is often worded nothing like your invention: a patent to a "rotatable annular closure member" may describe the exact bottle cap you think you invented. The USPTO's free Patent Public Search tool, Google Patents, and the nationwide network of Patent and Trademark Resource Centers—public, state, and academic libraries staffed by librarians trained to help you build a search strategy—are excellent starting points. You do not have to travel anywhere. Keep the asymmetry in mind: a DIY search that finds nothing should make you cautiously optimistic, not confident; a registered professional who finds nothing after a real search is a far stronger signal. Provisional vs. Nonprovisional: The Question Everyone Googles What is the difference? A nonprovisional application is the real thing. 35 U.S.C. § 111(a). It is the only application the USPTO actually examines and the only one that can mature into an issued patent. It needs a full specification, at least one claim, usually drawings, an inventor's oath or declaration, and the fees. A provisional application is a placeholder. 35 U.S.C. § 111(b). It is never examined, never published, and never becomes a patent on its own. What it does is fix an early filing date (a priority date) and let you say "patent pending." It is cheaper, its formal requirements are lighter (no claims required), and it buys you exactly twelve months. Within that year you must file a corresponding nonprovisional (or a PCT application) claiming the benefit of the provisional under 35 U.S.C. § 119(e); otherwise it simply expires and does nothing. There is no extension. Here is the catch people miss: a provisional protects only what it actually describes well enough to satisfy § 112's written-description and enablement standards. A thin provisional does not reserve territory it never taught. A worked example (hypothetical). In March, an inventor named Priya files a three-paragraph provisional describing a "modular vertical-farming rack" in general terms. Eleven months later she files a nonprovisional with detailed claims to a specific closed-loop nutrient-dosing controller the provisional never mentioned. Those controller claims do not get March's date—they get February's. Any prior art that surfaced in the intervening eleven months (a competitor's trade-show demo, a published application) can now be used against them. In a fast-moving field, that gap is fatal. The moral: treat a provisional as a genuine, complete disclosure, not a napkin. "I'll throw together a quick provisional" is precisely how people pay for a priority date they do not actually own. When does a provisional make sense? Provisionals shine when you need to plant a flag now: a competitor is circling, you are about to pitch investors, or you are about to launch or demo publicly. They also suit an invention you are still refining, buying a year to develop and to test the market before committing to the full nonprovisional spend, and they earn you "patent pending" for fundraising credibility. Because the country is first-inventor-to-file, a provisional is the cheapest way to stake priority, which is exactly why provisionals surged after the AIA. They are a worse idea when the invention is fully baked and you are ready to go, because the extra year mostly delays your eventual patent and your exclusivity. And never let the twelve-month runway lull you into drift—many promising inventions have died because the nonprovisional deadline slipped by unnoticed. Software, Apps, and Business Methods After Alice Can I patent software or a mobile app? Yes—with real caveats, and this is the corner of patent law where confident internet advice is most often wrong. Software is not categorically ineligible. A genuine, non-obvious technical improvement implemented in software can absolutely be patented. What you cannot do is take an abstract idea and make it eligible merely by running it on a computer. The Supreme Court drew that line in Alice Corp. Pty. Ltd. v. CLS Bank Int'l, 573 U.S. 208 (2014), applying the framework of Mayo. The resulting two-step test—everyone calls it Alice/Mayo—asks: (1) Is the claim directed to an abstract idea (or law of nature)? If so, (2) does it add an "inventive concept," something significantly more than the abstract idea implemented on a generic computer? In Alice, the claims used a computer as an intermediary to settle financial transactions—"a fundamental economic practice"—and doing an old idea on an ordinary computer was not enough. Four years earlier, Bilski v. Kappos, 561 U.S. 593 (2010), reached the same result for claims to hedging financial risk. So what survives? The Federal Circuit supplied the pattern. A claim directed to an improvement in the functioning of the computer itself—there, a self-referential database structure—is not abstract and clears step one outright. Enfish, LLC v. Microsoft Corp., 822 F.3d 1327 (Fed. Cir. 2016). Likewise, claims solving a problem "necessarily rooted in computer technology" survive. DDR Holdings, LLC v. Hotels.com, L.P., 773 F.3d 1245 (Fed. Cir. 2014). Three quick hypotheticals make the boundary concrete. An app that reminds you to drink water on a schedule is an abstract idea on a generic phone—hard to save. A new lossless codec that halves streaming bandwidth by restructuring how the machine encodes frames improves the technology itself—Enfish territory. A fraud-detection method that works only because it addresses how requests actually propagate across a distributed network—a problem that does not exist off the computer—looks like DDR. The consistent thread: improve how the machine works or solve a real technical problem, and you have a fighting chance; dress up an ordinary business practice as "on a computer," "on the internet," or "on a smartphone," and expect a rejection. A practical note for app builders: one app usually deserves a layered strategy—a patent for any genuine technical innovation, copyright on the code, trademarks on the brand, and trade secrets on what stays server-side. And if an AI system contributed to the invention, ownership and inventorship get genuinely thorny: the Federal Circuit has held that an "inventor" under the Patent Act must be a human being. A business method is a process for doing business, and processes are eligible in principle. But a pure business method runs headlong into the abstract-idea problem from Alice and Bilski. Tie the method to a real technological improvement and it has a chance; leave it as "a clever way to organize commerce" and it usually does not. This is a high-rejection area—go in with realistic expectations and good counsel. The AIA even created a special (now sunset) review procedure aimed squarely at financial business-method patents, a fair measure of how skeptical the system became. Prototypes, Disclosure, and the Traps That Quietly Kill Rights Do I need a working prototype? No. This is a beloved myth and it is false. You do not need a built, working prototype to file. What you need is to have conceived the invention completely enough to describe how to make and use it—the enablement and written-description requirements of § 112. A patent application is a teaching document, not a science-fair project. The law calls filing an enabling application a "constructive reduction to practice": the filing itself counts as reducing the invention to practice, even if you never build the physical thing. The narrow exception is inventions whose operability is genuinely in doubt—perpetual-motion machines and the like—where the USPTO may demand a model. That said, building a prototype is often practically valuable. It can reveal that the idea does not quite work, surface improvements worth claiming, or generate data that strengthens the application—all before you spend real money. Just do not let "I haven't built it yet" stop you from filing if you are otherwise ready, because someone else who files first can beat you. If I tell people about my invention, do I lose my rights? You can, so tread carefully. Premature disclosure is the most common, most avoidable, and most heartbreaking way inventors destroy their own rights. Three distinct risks hide here, and they behave differently. One: your own disclosure becomes prior art against you. The U.S. gives you a one-year grace period to file after your own public disclosure (35 U.S.C. § 102(b)(1)), but most foreign countries apply "absolute novelty" with no grace period. A splashy launch, a crowdfunding page, a trade-show demo, a journal article, or a too-detailed post can extinguish your foreign rights immediately and start a tight one-year U.S. clock. Worse, the U.S. grace period shelters only inventor-originated disclosures and does not cure the global damage—so even a disclosure you could disqualify at the USPTO may still sink patentability abroad. Experienced counsel repeat the rule like a mantra: file before you disclose. Two: a secret sale can trigger the on-sale bar. Under 35 U.S.C. § 102(a)(1), an invention "on sale" more than the grace period before filing is unpatentable. You might assume "on sale" means a public sale. It does not. In Helsinn Healthcare S.A. v. Teva Pharms. USA, Inc., 139 S. Ct. 628 (2019), the Supreme Court held that even a confidential commercial sale—where the fact of the deal was disclosed but the inventive details were kept secret—places an invention "on sale" and starts the clock. No public teaching of how the invention works is required. A worked example (hypothetical). A hardware founder named Devraj signs a confidential supply agreement with a contract manufacturer fourteen months before filing, thinking secrecy preserves his rights. It does not; the confidential commercial deal can itself start the on-sale clock, and by filing month fourteen he may already be barred. If you are commercializing before filing, raise this specific trap with counsel first. Three: theft of an unprotected idea. Before you file, the best protection when you must share the invention—with a manufacturer, an investor, a collaborator—is a well-drafted non-disclosure agreement (NDA), which contractually binds the recipient to keep the secret and not use it.
