Mr. Justice Day delivered the opinion of the court. We are met at the threshold o‘f this case with a challenge of the appellate jurisdiction of this court. The case was begun in the Circuit Court of the United States for the Western District of Tennessee by a bill filed by the Cumberland Telephone and Telegraph Company against the city of Memphis, seeking to enjoin the enforcement of the provisions of an ordinance of that city passed September 24, 1907, regulating charges by telephone companies in the city. The bill averred that the complainant was a corporation organized and existing under the laws of the State of Kentucky, and that the. respondent, the city of Memphis, was a municipal corporation created,, and existing under the laws of Tennessee.
