IN THE MATTER OF P----, 4 IN Dec. 235 (BIA 1951) IN THE MATTER OF P----. In DEPORTATION Proceedings. A-4593207Board of Immigration AppealsExecutive Office for Immigration ReviewU.S. Department of Justice Decided by Board January 17, 1951 "Entry" into the United States within meaning of Immigration Laws. An alien, who crossed the border from the United States into Mexico in 1945, procured an immigration visa thereafter under sec. 4 (b) of the Immigration Act of 1924 as "an immigrant previously lawfully admitted to the United States, who is returning from a temporary visit abroad", then returned to the United States about 3 or 4 days after his departure from the United States, was held to have effected an "entry" upon his return to the United States in 1945, within the meaning of the immigration laws as a matter of law, even if full credence were given to the respondent's claim that he did not knowingly depart from the United States because of his (voluntary) drunken condition, (the evidence of record not found supporting such claim).
