ON MOTION FOR REHEARING J. CURTISS BROWN, Chief Justice. This is an appeal from a take-nothing summary judgment. Appellants brought suit to impress a constructive trust on real property, or alternatively, for damages alleging tortious interference and violations of the DTPA. Appellees moved for summary judgment and, although the motion *184addressed only the issue of constructive trust, the trial court granted summary judgment on all three claims.
