The probate homestead shall be set apart for the use of one or more of the following persons:

Cal. Prob. Code § 6521 — Setting Aside Probate Homestead is in force in the current edition of the Code, and nothing recorded condemns it.
The probate homestead shall be set apart for the use of one or more of the following persons:
(a) The surviving spouse.
(b) The minor children of the decedent.
