*564 Mr. Justice Peckham, after making the above statement of facts, delivered the opinion of the court. Both parties in this case seem to agree that the statute of 1890, under which these proceedings were taken, is void as in violation of the.- state- constitution. As authority for that proposition the case of Hixson v. Burson, 54 Ohio St. 470, is cited.
