Mr Chief Justice Marshall delivered the opinion of the Court. This is’an action of replevin instituted in the circuit court for the county of Alexandria, and removed, for trial, to the county of Washington. The plaintiff in error, the original defendant, avowed as bailiff of William S. Moore, that the goods replevied were dis-trained for rent in arrear. The plaintiff in replevin, after craving oyer of the deed, by which the rent alleged to be in arrear was reserved, pleaded the statute of usury in bar of the claim.
