Mr. Justice Brown, after making the foregoing statement, delivered the opinion of the court. There being but little conflict in the testimony as to the actual facts, the question really is whether the- court should have submitted the case to the jury, or instructed- a verdict for the plaintiff. . By Rev. Stat. sec. 5151, “the shareholders of every national banking association shall be held individually responsible, equally, and ratably, and not one for. another, for all contracts, debts, and engagements of such association, to the extent of the amount of their stock therein, at the par value thereof, in addition to the amount invested in such shares;” and by sec. 5234, the receiver may, .upon order of the proper court, enforce this individual liability.
