Mr. Justice Gray, after stating the case as above, delivered the opinion of the court. In the Circuit Court of the United States, a verdict and judgment were rendered for the plaintiff for - a less amount of damages than he claimed; and each.party alleged exceptions to.rulings and instructions of the judge, and sued out a writ of error from the' Circuit Court of Appeals. That court, héld that the defendant’s demurrer to the complaint should have been sustained, and therefore reversed the judgment of the Circuit Court, and remanded the case for further proceedings. A writ of certiorari to review the judgment of the Circuit Court of Appeals was thereupon applied for by the plaintiff, and Was granted by this court.
