Mr. Justice Shiras, after stating the case, delivered the opinion of the court. The defendants in error have moved to dismiss the writ of error, because the sum or value of the matter in dispute is less than five thousand dollars, and -because the judgment of the.. court below does hot involve the validity of a statute of the •United States or of an authority exercised under the United. States. It is true that the amount or value of the matter in dispute is not sufficient to enable this court to exercise its revisory power *50 over the judgment, of the Court of' Appeals, but we think it plainly appears that the validity of statutes of the United States and of an authority exercised under the United States was drawn into, question in the court below, and is presented, by the assignment of error, for the consideration of this court.
