Mr. Justice Shiras, after making the above statement, delivered the opinion of the court. ' Our first inquiry is whether this court has jurisdiction to review the judgment of the Circuit Court of Appeals. The. writ of error in this case was brought under section six of the judiciary act of March 3, 1891. If the judgment of the Circuit Court of Appeals was final, under that section, this writ of error must be dismissed.
