Me. Justice McKenna delivered the opinion of the court. Action on two fire insurance policies issued by plaintiff in error, to which we shall refer as .the insurance company, to defendant in error, to which we shall refer as the lumber company. Each policy was for the sum of $2,500. There was total insurance on the property described in the policies of $45,750, and it was provided that the insurance company should only be liable for its pro rata share of any loss caused by fire under the provisions of the policies.
