MARTIN v. HARDING, 38 N.C. 603 (1845) SAMUEL MARTIN v. HENRY HARDING, Admr., Etc.Supreme Court of North Carolina (June Term, 1845.) 1. A creditor, may, by a proper bill, obtain accounts of the real and personal estates of his deceased debtor, and a decree for payment of his debts out of the proper fund. 2. But if he chooses to go on at law, and has the plea of "full administered" found against him, or confesses it, there is no ground for relief as against the executor or administrator, in equity, to set aside the verdict and judgment thereon, where the executor or administrator has been guilty of no fraud in misrepresenting the state of the assets.
