In the first, he in substance alleges that by a certain act of the legislature therein referred to, the defendants were authorized to take possession of the said bridge; that they did take possession of it; that it was then in good order so that it might be crossed and recrossed with safety; whereupon it became and was the duty of the defendants to construct the said bridge so that the same should be in no worse condition than it was at the time they commenced altering the said bridge; and that it then and there became and was the duty of the defendants so to construct the said bridge, that the same might be crossed and recrossed to and from the said pier, with safety and security and without danger. In the second count it is alleged in substance that the defendants were authorized to take possession of the said bridge, and were by the said act required to widen and construct the draw in the said bridge; that they did take possession of the said bridge; whereupon it became and was their duty so to widen and construct the said draw of the said bridge, that the same might with safety and security be crossed and recrossed to and from the said pier.
