Ruffin, J. The single question presented in this appeal is, whether the court of a justice of the peace can entertain an action against a married woman, brought upon a promise to pay for work done upon premises owned and held as her separate property. In Fisher v. Webb, 84 N. C., 44, a doubt was expressed as to whether that court had jurisdiction of any cause arising ex con-tracta against a feme covert; but as the point did not directly arise in that case, and was not necessarily involved in its decision, it was not intended to conclude it.
