PER CURIAM. Freda Acton appeals from a final decision of the district court1 granting Tosco Corporation’s motion for summary judgment. We affirm. Acton brought this action against Tosco Corporation on behalf of herself and other former employees of Tosco, under the Employment Retirement Income Security Act of 1974 (ERISA), as amended, 29 U.S.C. § 1001, et seq. Appellants alleged that Tosco’s failure to pay them severance benefits upon Tosco’s sale of its El Dorado refinery to Lion Oil Company (Lion) violated ERISA.
