CLARK, Circuit Judge. Randolph Godfrey Phillips, a native-born American citizen aged 32 years, duly registered under the Selective Training and Service Act of 1940, 50 U.S.C.A.Appendix, § 301 et seq., but claimed exemption from combatant service as a conscientious objector under its provisions, 50 U.S.C.A.Appendix, § 305(g). This claim, together with other claims for deferred classification, was disapproved by the local board, and thereafter by the appeal board, after a hearing conducted by the Department of Justice according to the statute cited and upon the report, November 23, 1942, of Honorable Lamar Hardy, Hearing Officer. Further appeal to the President was denied. Phillips was, therefore, inducted into service on March 6, 1943, and was orderd to, and did, proceed to Camp Upton on March 13, 1943.
