JOHN P. MOORE, Circuit Judge. This is an appeal from a judgment which the appellant claims should have been barred by the Utah statute of limitations. Plaintiffs brought this action against Rena Chynoweth for the wrongful death of Ru-lon Allred. In rulings on a motion to dismiss and a motion for summary judgment, *529the district court concluded the statute of limitations did not bar the plaintiffs’ cause of action.
