MARTINEAU, District Judge. Silas A. Leonard was a soldier in the World War and carried $10,000 war risk insurance, with his sisters, the plaintiffs in this case, named in the policy as beneficiaries. Subsequent to the issuance of the policy he married the defendant, whose name is now Ruby McSpadden, and made a will giving her the insurance involved in this suit. The will is clear and unambiguous, and leaves no doubt but that the intention of the soldier was to give his wife his insurance, and, when the will was called to the attention of the government, it awarded her the insurance and began making payments in accordance with the provisions of the policy.
