Headnotes

  1. Criminal Law & Procedure — Burden of Proof In a prosecution for carrying on the business of a distiller without giving the required bond, or for possession and control of a still not registered as required, proof that the still was in the custody and control of the defendants and was set up and operating, or ready to operate, in a dwelling house is sufficient to support an inference of failure to register and failure to give bond; the burden then rests on the defendants to show execution of the bond and registration of the still. 289 U.S. at 90
  2. Criminal Law & Procedure — Burden of Proof The prosecution is not required to adduce positive evidence to support a negative averment where the truth of that averment is fairly indicated by established circumstances and, if untrue, could readily be disproved by the production of documents or other evidence probably within the defendant's possession or control. 289 U.S. at 91
  3. Criminal Law & Procedure — Internal Revenue Under § 3266, Rev. Stats. (26 U.S.C. § 291), no person may lawfully register, or have lawful custody or control of, a still set up in a dwelling house for the manufacture of alcoholic spirits. 289 U.S. at 91
