OPINION. Arundell, Judge: The issue herein concerns the includibility in decedent’s gross estate of the sum of $37,483.25 paid to his executrix under the terms cf the bonus plan of decedent’s employer. The respondent has determined that the payment is subject to the estate tax under section 811 (a) or 811 (f) of the Internal Revenue Code, or both, and that a deficiency of $1,930.70 exists in the estate tax. Section 811 (a) provides “The value of the gross estate of the decedent shall be determined by including the value at the time of his death of all property * * * To the extent of the interest therein of the decedent at the time of his death.” Under the provisions of an established bonus plan, decedent’s employer awarded substantial sums to him in 1946, 1947, and 1948. Part of the 1948 cash award was required to be invested in capital stock of the corporate employer.
