Smith, C. J. To carry out the directions of the act for the construction of a fence around the boundaries of Davie county, (which we have examined at the present term in the appeal in the case of Cain against the present plaintiffs) and in pursuance of notice served on the defendant, the plaintiffs applied to the judge holding the spring terms of the superior courts of the seventh district, at Winston, on May 17th, 1881, for an order appointing commissioners to view the lands of the defendant and assess his damages for the condemnation thereof for a fence-way along the county line. Acts 1881, ch. 172, §§ 10 and 11. The statute requires this to be done, “ as land is now condemned for railroad *19 purposes by the North Carolina railroad company,” and the method of procedure is pointed out in section 17 of chapter 82 of the acts of 1848-49, incorporating that company.
