SEEKRIGHT v. BOGAN, 2 N.C. 176 (1795) SEEKRIGHT, ON THE DEMISE OF WRIGHT AND WIFE, v. PATRICK BOGAN.Superior Court of North CarolinaFAYETTEVILLE — April Term, 1795 It is the first patent or grant, and not the first entry in the land office, that gives the best title. In the case of lapped patents where both are in possession of their respective tracts, but neither actually settled on the lapped part, the oldest grantee will be considered as having the legal possession of that part. Plaintiff may prove the loss of his deed by his own oath, but not that the plat offered in support of his title was part of the deed lost.
