COPPER COMPANY v. MARTIN, 70 N.C. 300 (1874) DEEP RIVER COPPER COMPANY OF BALTIMORE, MD. v. B. F. MARTIN.Supreme Court of North Carolina (January Term, 1874.) Where judgment has been obtained in an attachment against a company, upon a fraudulent demand, sued by a wrong name, and having no notice of the action, such judgment should be set aside and the company allowed to plead, although the same was known by one name as well as another.
