Mr. Presiding Justice Barry delivered the opinion of the court. Appellee recovered a verdict and judgment for $1,400 for personal injuries sustained by her when struck by appellant’s car. The first count of the declaration charged general negligence in the operation of the car, and the second a failure to sound the horn or give any other signal of the approach of the car to the crossing in question. Each count averred that appellant provided the car for the use and pleasure of Ms family and that at the time in question it was driven by appellant’s wife as his agent.
