*218MYRON L. GORDON, District Judge. This is a habeas corpus action in which both the petitioner and the respondents cross appeal from the judgment of the district court. The petitioner appeals from the district court’s findings that the petitioner was not deprived of his sixth amendment right to counsel at trial and that the petitioner was not entitled to a hearing on his allegation of prejudice on the part of the trial judge. The respondents appeal from the finding of the district court that the petitioner’s sixth amendment right to counsel was violated at sentencing.
