EVANS, Circuit Judge. Appellee brought this suit to enjoin the continued operation of a radio broadcasting station (WMBB-W0K), which was being operated by appellants after the Federal Radio Commission had refused their application for a renewal of license. The District Court granted the injunction, and this appeal followed. When this appeal was first presented to this court, it appeared to us and to counsel that there were certain questions or propositions of law concerning which instructions from the Supreme Court were desirable, and we accordingly certified such questions or propositions to the Supreme Court, under the supposed authority of section; 346, tit. 28, US CA.1 But the Supreme Court concluded that the questions certified need not be answered, and dismissed the certificate.
