KF.RNER, Circuit Judge. This action was brought to recover damages occasioned by the publication of an alleged libel concerning plaintiff in a labor union newspaper. Jurisdiction was based on diversity of citizenship. The union and its officers were made defendants. On motions to dismiss, the court held that the union was not suable in its association name under the law of Illinois, that the language complained of was not libelous per se, and dismissed the case.
