WHITAKER, Judge. Plaintiff sues defendant for the infringement of his patent on an “Automatic Means for Opening Parachutes,” being United States Letters Patent, No. 2,365,445. The issue now presented is the question of infringement and validity. The amount of recovery is reserved for later determination in case the court finds that the patent is valid and has been infringed. Defendant says, first, its structure did not infringe plaintiff’s patent; and, second, that the patent is invalid anyway, because anticipated by the prior art.
